1. General Provisions
1.1. These Donation and Refund Terms (hereinafter referred to as the “Terms”) establish the conditions for making donations to VšĮ “Diversity Development Group”, legal entity code 302877111 (hereinafter referred to as the “Organisation”), through its website, as well as the rights and obligations of the person making a donation (hereinafter referred to as the “Donor”) and the Organisation.
1.2. VšĮ “Diversity Development Group” is a non-profit organisation operating in the fields of human rights, equal opportunities, diversity, migration and integration.
1.3. By making a donation to the Organisation, the Donor confirms that they have read and agree to these Terms.
1.4. The Organisation reserves the right to amend or supplement these Terms. The current version of the Terms is published on the Organisation’s website.
2. Making a Donation
2.1. The Donor may make a one-off donation or, where such an option is available on the website, a recurring donation to the Organisation.
2.2. The Donor selects the desired donation amount and one of the payment methods available on the website and provides the information required to process the payment.
2.3. A donation is considered completed once the Donor’s payment has been successfully processed.
2.4. The Donor is responsible for ensuring that the information provided when making a donation is accurate.
2.5. The Organisation reserves the right to refuse a donation if accepting it would be contrary to the laws of the Republic of Lithuania, the Organisation’s principles, or could reasonably pose legal or reputational risks.
3. Use of Donations
3.1. Donations received by the Organisation are used to support the purposes set out in its Articles of Association and to finance its activities.
3.2. Where a Donor makes a donation for a specific initiative, project or activity of the Organisation and this purpose is clearly indicated at the time of donation, the Organisation will seek to use the donation for the stated purpose.
3.3. If, due to objective circumstances, a donation cannot be used for its specified purpose, the Organisation reserves the right to use it for another activity that most closely reflects the original purpose of the donation, unless otherwise required by applicable law or a separate agreement.
4. Payment Methods and Currency
4.1. Donations can be made using the online banking services of Swedbank, SEB, Luminor, Citadele and Artea Bank, as well as other payment methods displayed on the website at the time of donation.
4.2. Donations are processed in euros (EUR).
4.3. Payments are processed using the MakeCommerce payment platform.
4.4. Information required to process the payment is transferred to the payment service provider. The Organisation does not store the Donor’s online banking login credentials or payment card details.
5. Refund Policy
5.1. If a Donor accidentally makes a donation for an incorrect amount, makes a payment by mistake, or experiences another payment-related issue, they may contact the Organisation at info@diversitygroup.lt and submit a request for a refund.
5.2. The refund request should include the Donor’s name, the date and amount of the payment, and sufficient information to identify the transaction.
5.3. Refund requests are assessed individually, taking into account the circumstances of each case and the requirements of applicable Lithuanian law.
5.4. If a refund is approved, the funds will be returned using the same payment method used for the original transaction, where technically possible.
5.5. If it is not technically possible to refund the donation using the original payment method, the Organisation may request additional information from the Donor necessary to process the refund.
6. Personal Data Protection
6.1. Personal data provided when making a donation is processed in accordance with applicable data protection legislation and the Organisation’s Privacy Policy.
6.2. Personal data is processed to the extent necessary to administer donations and payments, communicate in relation to donations, comply with legal obligations, and for other purposes specified in the Organisation’s Privacy Policy.
6.3. Further information about the collection, use and storage of personal data and the Donor’s rights is available in the Privacy Policy published on the Organisation’s website.
7. Rights and Liability of the Organisation
7.1. The Organisation reserves the right to temporarily or permanently suspend the donation functionality for technical, security or other objective reasons.
7.2. The Organisation is not responsible for disruptions to the systems of payment service providers, banks or other third parties that are beyond the Organisation’s reasonable control.
7.3. If a Donor attempts to interfere with the operation, stability or security of the website, the Organisation reserves the right to restrict or suspend their access to the donation functionality.
7.4. The Organisation undertakes to administer donations responsibly and in accordance with the laws of the Republic of Lithuania.
8. Final Provisions
8.1. These Terms are governed by the laws of the Republic of Lithuania.
8.2. The laws of the Republic of Lithuania apply to these Terms and to the relationship between the Organisation and the Donor in connection with donations.
8.3. Any disputes arising from donations or the application of these Terms shall first be resolved through negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedures established by the laws of the Republic of Lithuania.
8.4. Neither party shall be liable for failure to fulfil its obligations where such failure results from circumstances beyond its reasonable control (force majeure).
